Samsung Display and Chinese display maker BOE have been involved in legal battles in the United States for a few years now. It claimed that BOE and its subsidiaries had infringed on its AMOLED patents.
A preliminary ruling has now been issued by the US International Trade Commission (ITC) which agrees that BOE did infringe on several of Samsung Display's OLED patents. It has recommended sanctions which include a ban on the import of BOE's OLED panels in the US.
The ITC found BOE and seven of its subsidiaries in violation of Section 337 of the Tariff Act due to infringement of Samsung Display's trade secrets. The preliminary recommendation suggests two types of sanctions.
The first would ban the import of BOE OLED panels and associated components in the US while the second would be a cease and desist order that will immediately ban BOE from marketing, distributing, and selling products that have the infringed technology both in the US and in other markets.
Experts highlight that while these may be preliminary recommendations at this stage, it rarely happens that the sanctions that eventually get implemented are different from the recommendations. ITC is expected to issue its final ruling on the matter in November this year.
This could potentially complicate BOE's supply deal with Apple. It has left no stone unturned in becoming a display supplier to Apple. A blanket ban on the import of its OLED products in the US, even if limited to those that contain infringed technology, could mean that it may no longer be able to capitalize on orders from the iPhone maker.
